Terms and Conditions for By The Pitch

Welcome to By The Pitch!
These Terms and Conditions (“Terms”) govern your use of the By The Pitch website located at https://bythepitch.com (the “Website”) and all related services, products, and software provided by By The Pitch (“Company”, “we”, “us”, “our”).
By accessing or using our Website and Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Website or Services.
1. Our Services
Our company provides a range of sporting and software services (“Services”), including but not limited to:
- Sporting Residential Camps: Such as Reps Football and Reps Tennis.
- Software as a Service (SaaS): Including Pitch Flow, Scout Pulse, and PitchsideHQ.
- Free Software Tools: Such as Fee Tracker.
Specific terms may apply to individual Services, and you will be asked to agree to those additional terms when you sign up for or purchase that Service.
2. Accounts and Registration
To access certain Services (particularly our software), you may be required to create an account. You agree to:
- Provide accurate, current, and complete information during the registration process.
- Maintain the security of your password and account credentials.
- Notify us immediately of any unauthorised use of your account.
- Accept all risks of unauthorised access to your account and the information you provide to us.
3. Terms for Sporting Camps
- Bookings and Payments: All bookings for residential camps are subject to availability and confirmation. Full payment is required by the date specified at the time of booking.
- Cancellations and Refunds: Our cancellation and refund policy will be provided at the time of booking. Please review it carefully. We reserve the right to cancel a camp due to insufficient enrolment or other unforeseen circumstances, in which case a full refund will be provided.
- Participant Conduct: We expect all participants to behave in a respectful and responsible manner. We reserve the right to remove any participant who fails to comply with camp rules, without a refund.
- Medical and Liability: You must provide accurate medical information for each participant. By registering, you consent to emergency medical treatment if required. Participation in sporting activities carries inherent risks, and you agree to release By The Pitch from liability for injuries, subject to applicable law.
4. Terms for Software Services
- Licence: We grant you a limited, non-exclusive, non-transferable licence to use our software for the duration of your subscription or as long as the free service is offered.
- Subscriptions and Renewals: Paid software services are billed on a subscription basis. Your subscription will automatically renew at the end of each billing cycle unless you cancel it.
- Data: You retain all rights to the data you upload to our software services. We will not access or use your data except as necessary to provide and improve the Services. Please see our Privacy Policy for more details.
- Acceptable Use: You may not use our software for any illegal or unauthorised purpose. You must not, in the use of the Service, violate any laws in your jurisdiction.
5. Intellectual Property
The Website and its original content, features, and functionality (including all software, text, graphics, logos, and images) are and will remain the exclusive property of By The Pitch and its licensors. Our trademarks may not be used in connection with any product or service without our prior written consent.
6. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall By The Pitch, its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
